Terms of Use

1.1 The Service

BTOwhere is a Singapore-focused HDB BTO housing intelligence platform that provides AI-powered analysis, personalised project recommendations, unit selection guidance, comparable sales data, and location intelligence to help users make informed decisions about HDB Build-To-Order housing. The Services include our website, web application, and all related functionality.

You must be at least 18 years old to use BTOwhere. If you are under 18, you may not use the Services.

1.2 License to Use Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial purposes.

1.3 Service Changes and Updates

We regularly improve our Services. We may, for example:

• Update, modify, or discontinue any part of the Services at any time
• Impose or modify limitations on certain features
• Restrict access to parts or all of the Services

We will try to give you notice of material changes that adversely affect you, but this is not always practical.

1.4 Availability

We strive to ensure high reliability and uptime, but we make no guarantee of availability. The Services are provided "as is" and "as available." We integrate with third-party data sources and services — including HDB, OneMap, LTA DataMall, and Data.gov.sg — that we do not control or guarantee.

1.5 Changes to These Terms

We may change these Terms from time to time. If we do, we will:

• Update the "Last Updated" date
• Post the updated Terms on our website

Your continued use of the Services after changes take effect means you agree to the new Terms. If you do not agree, you must stop using the Services.

2.1 Creating an Account

An account is required to access personalised BTO recommendations, saved projects, and AI-powered analysis features. When you create an account, you must:

• Provide accurate, complete, and current information
• Keep your registration information up to date
• Not impersonate others
• Be at least 18 years old

2.2 Third-Party Account Access

You may access the Services using credentials from third-party services such as Google. By doing so, you permit us to access certain information from that account as allowed by your privacy settings.

2.3 Account Security

You are responsible for:

• Keeping your account credentials secure
• Not sharing your account with anyone
• All activities that occur under your account

Notify us immediately at BTOwhere if you suspect unauthorised use of your account.

2.4 Account Restrictions

You may not:

• Create an account using false information
• Create an account on behalf of someone else without permission
• Have more than one account at a time
• Create a new account if we have previously terminated your account

2.5 Account Termination

We may suspend or terminate your account at any time if you violate these Terms. You may also permanently delete your account and all associated data at any time from your Profile settings. If an account is terminated or deleted:

• You lose access to all Services and your data
• We have no obligation to store or return your data
• All deletions are final and irreversible

3.1 Your Responsibilities

You are solely responsible for all content you submit through the Services, including questionnaire responses, search queries, and any other information you provide ("User Content"). You represent and warrant that your User Content does not infringe any third-party rights and complies with these Terms and applicable law.

3.2 Prohibited Conduct

You may not use the Services to:

• Engage in any unlawful, harmful, fraudulent, or deceptive activity
• Violate any applicable Singapore or international law or regulation
• Harass, threaten, or harm other users or third parties
• Submit content that is defamatory, discriminatory, or promotes violence
• Introduce viruses, malware, or harmful code
• Place unreasonable load on our infrastructure
• Use automated tools to scrape, crawl, or copy data
• Access our Services through means other than the official website or application
• Circumvent any security, rate-limiting, or authentication features

3.3 Enforcement

We reserve the right, but have no obligation, to monitor and review User Content, remove or refuse to process any User Content, and terminate accounts that violate these Terms. To report violations, contact BTOwhere.

4.1 Nature of AI Analysis

BTOwhere uses large language model AI to generate personalised property analysis, unit selection guidance, and natural language search results. These outputs are generated automatically based on your stated preferences and publicly available data.

4.2 No Guarantees on AI Output

• AI-generated analysis and recommendations may be unpredictable or imperfect
• Outputs are not guaranteed to match your expectations or individual circumstances
• We make no warranties regarding the accuracy, completeness, or fitness of any AI-generated content
• You are solely responsible for how you use and rely upon AI-generated analysis

4.3 Data Sources and Accuracy

Property data displayed on BTOwhere is sourced from publicly available datasets including HDB Sales Launch Brochures, Data.gov.sg HDB resale transaction records, OneMap, and LTA DataMall. Please note:

• All distance measurements carry a tolerance of approximately ±15%
• Data may not reflect the most current HDB release information
• Comparable sales data represents historical transactions and is not a guarantee of future market value
• BTOwhere is not affiliated with, endorsed by, or acting on behalf of HDB or any Singapore government agency

4.4 Not Professional Advice

Nothing on BTOwhere constitutes financial, legal, or property investment advice. All analysis and recommendations are for informational purposes only. You should conduct your own due diligence and consult qualified professionals before making any property-related decisions.

4.5 Access Restrictions

• Only access our Services through the official BTOwhere website or application
• Only real human interactions are allowed
• Automated access, bots, and scripts are prohibited

5.1 BTOwhere's Rights

Except for User Content and third-party data, BTOwhere and its licensors own all rights, title, and interest in the Services, including software, code, and algorithms; designs, graphics, and user interfaces; trademarks and branding; and documentation and content. You may not remove, alter, or obscure any copyright, trademark, or proprietary notices.

5.2 Third-Party Data

Data sourced from HDB, Data.gov.sg, OneMap, and LTA DataMall remains the property of their respective owners and is used in accordance with their applicable terms and licences. BTOwhere makes no claim of ownership over such data.

5.3 Copyright Notices

If you believe content on BTOwhere infringes your copyright, please contact BTOwhere with the following:

• Identification of the copyrighted work being infringed
• Identification of the infringing material and its location on BTOwhere
• Your contact information
• A statement of good faith belief that the use is not authorised
• A statement under penalty of perjury that the information is accurate and you are authorised to act

6.1 "As-Is" Service Warranty Disclaimer

THE SERVICES ARE PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BTOWHERE DISCLAIMS ALL WARRANTIES, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• That the Services will be uninterrupted, timely, secure, or error-free
• That results, analysis, or recommendations will be accurate or reliable
• That errors or malfunctions will be corrected

6.2 AI and Data Disclaimer

We make no representation or warranty regarding:

• The accuracy, completeness, or timeliness of AI-generated analysis
• The accuracy of property data sourced from third parties
• Whether information is current relative to the latest HDB announcements
• The suitability of any BTO project or unit for your individual circumstances

6.3 Third-Party Content Disclaimer

We are not responsible for the accuracy, legality, or quality of content from HDB, Data.gov.sg, OneMap, or other third-party sources, nor for third-party websites or services linked from our Services.

6.4 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BTOWHERE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Any loss arising from reliance on AI-generated recommendations or property data
• Loss of data or goodwill
• Business interruption
• Delays or failures resulting from causes beyond our reasonable control

6.5 Indemnification

You agree to indemnify, defend, and hold harmless BTOwhere, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, and expenses arising from or relating to your use or misuse of the Services, your User Content, your violation of these Terms, or your violation of any applicable law or third-party rights.

8.1 Governing Law and Venue

These Terms are governed by the laws of Singapore, without regard to conflict of law principles. For disputes not resolved by negotiation, you agree to submit to the non-exclusive jurisdiction of the courts of Singapore.

8.2 Electronic Communications

You consent to receive communications from us electronically, including email messages and notices posted within the Services. You agree that all such electronic communications satisfy any legal requirement for written communications.

8.3 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations without our prior written consent. We may freely assign these Terms without your consent. Any attempted transfer in violation of this section is null and void.

8.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BTOwhere regarding the Services and supersede all prior agreements and understandings.

8.5 Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

8.6 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

8.7 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

8.8 Relationship of Parties

These Terms do not create any agency, partnership, joint venture, employment, or franchisee relationship between you and BTOwhere.

8.9 Language

These Terms are drawn up in English. In the event of any conflict between an English version and a translated version, the English version prevails.
